WHAT THIS WARRANTY COVERS
This Warranty guarantees the PermaSeal Tire Sealant Protection (the “System”) that You purchased for the Vehicle identified on the front registration page (the “Vehicle”). The System is a chemical tire application product when applied into Your tubeless tires, provides protection against rim and seal bead leaks, stops under-inflation from rubber tire porosity, and seals tread punctures made by penetrating objects up to 1/2 inches in diameter which is designed to prevent damage from a Puncture or Blowout by preventing loss of air due to punctures or other damage while driving on a public roadway, such as damage from a pothole, nails, glass, or other road debris.
WARRANTY BENEFITS
If the system fails to work as intended, We will reimburse You the amount to repair or replace the damaged area(s), up to the Program Limits set forth. Should the original tire be damaged by punctures from road debris or due to the inability to safely retain air pressure, We will repair or replace the covered tire per the Program Limits.
- ELIGIBLE TIRES are Your tires that have a minimum remaining tread depth of three/thirty seconds of an inch (3/32”) and have been installed with the the PermaSeal Tire Sealant Protection product. Should Your tire(s) require replacement during the coverage term of this Limited Warranty, the replaced tire(s) must receive reapplication of the PermaSeal Tire Sealant Protection product to be eligible for continuation of eligibility. Service Drive Sale/Non Point of Sale Delivery must have a minimum tread depth of five/thirty seconds of an inch (5/32”) at time of application with no signs of dry rot and has a 30-day claim waiting period for claim eligibility under this Limited Warranty.
- FLAT TIRES: You will be reimbursed for the costs You incur up to the Program Limits to repair a flat tire caused by a Puncture or Blowout while operating the vehicle on public streets and in a legal manner.
- TIRE REPLACEMENT: You will be reimbursed for the costs You incur to replace a tire up to the Program Limits only if a tire covered by this Warranty becomes unrepairable due to damage caused by a Puncture or Blowout. This coverage is valid through the tread life of a tire (2/32” or less is excluded) and replacement will be made with a tire of like kind and quality to the original tire.
- MOUNTING AND BALANCING: You will be reimbursed for the reasonable costs that You incur for mounting, balancing, valve stems, and tire disposal for any tire replaced under this Warranty up to the Program Limits. However, charges for pressure sensing devices, noise mitigation devices, shop supplies, or any other parts not specified in this Warranty are hereby excluded.
- TAXES: You will be reimbursed for the cost of local and state taxes, as directed by state agencies for any tire replaced under this Warranty within Program Limits.
PROGRAM LIMITS
The total dollar benefit allowed under this Warranty is $2,500.00 (Two Thousand Five Hundred Dollars) aggregate per Vehicle. A loss is damage to the covered tire that has been treated with the PermaSeal Tire Sealant, as a result of the failure of the PermaSeal Tire Sealant to work as intended.
TERM
This Warranty takes effect at the time You purchase the PermaSeal Tire Sealant Protection and expires at the end the term listed on the front registration page from the purchase date.
WHO THIS COVERS
This Limited Warranty is offered to You, the Purchaser(s) listed on the front registration page. Only You, and any person who is entitled under applicable state law, may enforce the obligations of this Limited Warranty.
REPAIR OBLIGATIONS
Administrator has sole discretion in determining and implementing repair procedures. Such services will be performed with reasonable promptness and quality.
CLAIMS PROCEDURE:
YOU MUST OBTAIN AUTHORIZATION PRIOR TO REPAIR OR REPLACEMENT OF ANY TIRE. For authorization and instructions please call the Administrator, D&P Holdings, Inc., at 800-353-1123 Monday through Thursday from 8:30a.m. to 5 p.m. CST and on Friday from 8:30am to 4pm CST. In the event that the tire damage occurs after the Administrator’s regular business hours, you may proceed with the necessary repairs. You MUST contact the Administrator on the following business day. A proof of loss form will be provided which MUST be completed and returned to D&P Holdings, Inc. Claims within thirty (30) days along with the following documentation:
- A copy of this Warranty;
- Original replacement or repair invoice which must reflect:
- The tread depth of the damaged tire;
- Whether or not the damaged tire was repairable, and if not, why not;
- Picture(s) of the damaged tire due to failure of the PermaSeal Tire Sealant System. Pictures may be emailed to clai[email protected], please include the claim the number for reference.
- Any other information that the Administrator reasonably requests.
NOTE: THE ADMINISTRATOR RESERVES THE RIGHT TO INSPECT ANY DAMAGED TIRE PRIOR TO ITS REPAIR OR DISPOSAL. FAILURE TO PRESERVE THE DAMAGED PROPERTY MAY RESULT IN CLAIM DENIAL.
Reimbursement will be provided, pursuant to the coverage and limits of this section, for covered claims. The Administrator, at its sole discretion, has the right to inspect or require photographs of any damage prior to paying any claim benefit. Replacement parts may consist of non-original manufacturer’s parts. Administrator reserves the right to void the Contract or deny claims at any time due to misuse, fraud, or misrepresentation. FAILURE TO SUBMIT ALL THE REQUIRED DOCUMENTATION WITHIN THIRTY (30) DAYS FROM THE ONSET OF DAMAGE VOIDS THE CONTRACT PERTAINING TO SUCH DAMAGE.
The Administrator makes every effort to provide service, however there may be instances where there are no vendors available in Your area. In such an instance, the Administrator reserves the right to make cash settlements in lieu of providing service. Such settlement will be based on market rates for like services in Your general geographic area.
ELIGIBLE VEHICLES include current model year plus fifteen (15) years prior
EXCLUSIONS
This Warranty does not cover: a) Any damage that occurs outside the United States, Canada or Puerto Rico; b) Any damage resulting from collision with a curb, median, or another vehicle, vandalism or malicious mischief, theft, fire, or any loss covered by primary physical damage insurance; c) Any damage to tires and/or wheels transferred from another vehicle subsequent to the purchase date of this Warranty; d) Any damage which is covered by any other Warranty, including warranties issued by the manufacturer, which by public announcement of a recall, established its responsibility to replace tires or wheels; e) Any consequential loss or damage whatsoever, including loss, damage, or injury to persons or property resulting from the failure of any of the parts of the Vehicle described herein, the replacement of which are covered under the terms and conditions of this Warranty; f) Any loss where You or any person on Your behalf falsely swears or commits any fraudulent act, misrepresentation or misuse with respect o any claim; g) Any repair or replacement that is not pre-authorized, other than terms described in claims procedure; h) Any loss that is not reported to the Administrator within sixty (60) days from the date the damage occurs; i) Any damage to tires with tread depth of 2/32″ or less at the lowest point of the tire; j) Any damage related to acts of God or acts of war or terrorism; k) Any wheel constructed of carbon fiber, ceramic, or any material other than steel or aluminum alloy; l) Any pre-existing conditions or damage; m) Claims for which replacement is performed without prior authorization from Us; and n.) Claims relating to any vehicle not identified on the first page of this Warranty.
GENERAL TERMS AND CONDITIONS
The terms and conditions of this Warranty cannot be altered unless in writing by Us. This Warranty specifically excludes Us from liability for incidental or consequential damages occasioned by use of the products. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exception may not apply to You. No express rights are given under the Warranty except for those specifically described herein. This Warranty gives You specific legal rights and You may also have other rights which vary from state to state.
The following terms and conditions apply:
- This Warranty applies only to the treated tires for the Vehicle identified at the top of the first page of this Warranty.
- All claims documents for reimbursement of damage or repairs of the treated tires must be submitted within 30 days after the loss.
- We reserve the right to attempt to repair any damage before issuing any replacements
- Vehicle as used throughout this contract means the Vehicle listed in the registration section of this Warranty.
- Reimbursement is limited to the reasonable and customary costs of repairs or replacements as determined by Us using the Original Equipment Manufacturer’s pricing index and/or other nationally recognized guides for parts and labor costs. Replacements shall be of like kind and quality as the original parts.
- We will not reimburse You for any costs unless You obtain prior authorization from Us in accordance with the Claims Procedure described below.
TRANSFER PROCEDURE
You, the Purchaser, may request transfer of this Warranty at the time of the Covered Vehicle’s resale to an individual subject to a $50 administrative transfer fee. To request transfer of this Warranty You must contact the Administrator within thirty (30) days of the date of resale of the Covered Vehicle. Copies of the first page of this Contract, the new registered title, and bill of sale are required by Administrator to process the transfer request. This Warranty is not transferable to another vehicle. The right to cancel this Warranty is not transferable and only applies to the original Purchaser.
CANCELLATION OF CONTRACT
The PermaSeal Tire Sealant Protection product has been applied to the described vehicle and the Limited Warranty is NON-CANCELABLE AND NONREFUNDABLE. The Warrantor may cancel this Limited Warranty in the event of fraudulent act, illegal act, or material misrepresentation of the Purchaser, whether acting alone or in collusion with others.
Obligations of the Warrantor under this Warranty are guaranteed under a reimbursement insurance policy issued by Lexington National Insurance Corporation, PO BOX 6098, Lutherville, MD 21094. If the Warranty benefit or refund is not provided by Administrator within sixty (60) days after all claim requirements have been met, Owner/Purchaser may apply for reimbursement directly to Lexington National Insurance Corporation via the address listed above.
INCIDENTAL AND CONSEQUENTIAL DAMAGES:
You are not entitled to recover incidental or consequential damages of any kind under this Warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exception may not apply to You. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
